Arthur Kane recently published an article that cited the default rates of cigarette and liquor stores with SBA loans. The article can be found here

The article notes that "liquor stores funded by the SBA loans defaulted on more than $77 million and tobacco businesses defaulted on nearly $2.5 million on federally backed loans in the past six years, analysis of the database shows."

Although the total dollar amounts are large, it is not clear from the article whether this is a abnormal percentage of all such business that default. For instance, with the SBA's 7(a) loan program, well known franchises Quiznos and Cold Stone Creamery have default rates hovering around 30% as noted on our website previously. These are very high default rates compared to other franchises.

The article also discusses the cross-purpose of the U.S. government providing a backstop by way of SBA guaranteed loans for liquor stores and cigarette shops while conversely the U.S. government spends millions of dollars each year combating alcohol and cigarette use.

The client was personally guaranteed an SBA 7(a) loan to help with a relative’s new business venture.  After the business failed, Treasury was able to secure a recurring Treasury Offset Program (TOP) levy against our client’s monthly Social Security Benefits based on the claim that he owed over $1.2 million dollars.  We initially submitted a Cross-Servicing Dispute, but then, prepared and filed an Appeals Petition with the SBA Office of Hearings and Appeals (SBA OHA).  As a result of our efforts, we were able to convince the SBA to not only terminate the claimed debt of $1.2 million dollars against our client (without him having to file bankruptcy) but also refund the past recurring amounts that were offset from his Social Security Benefits in connection with the TOP levy.
