Book a Consultation CallWhen a small business owner faces the daunting challenge of an SBA loan default, the stakes are incredibly high. Not only is the business at risk, but personal assets can also be endangered due to the personal guarantees often required for these loans. Understanding the intricacies of SBA loan default representation is critical to protecting both your business and personal assets. This guide will explore how specialized legal representation can offer a lifeline during these trying times.
Defaulting on an SBA loan can trigger a series of aggressive collection actions by the lender and potentially the SBA itself. Initially, the lender will attempt to collect the debt through standard means. If these efforts fail, the lender may request the SBA to honor its loan guarantee, which can lead to the involvement of the U.S. Department of Treasury for collections. This escalation can result in wage garnishments, asset seizures, and severe damage to your credit score.
Many SBA loans require personal guarantees, meaning that in the event of a default, lenders can target your personal assets, such as your home or savings, to satisfy the debt. This potential loss amplifies the stress and urgency of resolving the default. A qualified SBA loan default attorney can provide strategic defense to mitigate these impacts.
SBA loan default cases are uniquely complex due to the involvement of federal agencies and specific regulations. An SBA loan default lawyer brings a deep understanding of these rules, ensuring that your case is handled with precision and expertise. They can navigate the procedural nuances and represent you before entities like the SBA Office of Hearings and Appeals, where not all attorneys are authorized to practice.
Lawyers specializing in SBA loan defaults focus on practical, results-oriented solutions. They evaluate settlement opportunities, deferment options, and restructuring possibilities. This approach not only aims to minimize costs but also maximizes favorable outcomes. For instance, they can negotiate an SBA Offer in Compromise (OIC), allowing you to settle the debt for less than the total amount owed, provided certain criteria are met.
An SBA Offer in Compromise is a negotiation tool that allows borrowers to settle their debts for less than the full balance. This option is particularly viable if the business has ceased operations and assets have been liquidated. However, it requires comprehensive analysis and documentation of your financial situation, including asset valuations and ability-to-pay assessments. An SBA default attorney can guide you through this intricate process, ensuring that all necessary elements are addressed.
For businesses facing temporary financial hardship, deferment or forbearance might be viable options. An SBA loan default lawyer can help you apply for these relief measures, providing strategic guidance and representation to present a compelling case to the lender or SBA. This can buy you valuable time to stabilize your business and avoid immediate collection actions.
For small businesses, Chapter 11 Subchapter V offers a streamlined and cost-effective bankruptcy option. This allows for reorganization and potential discharge of federal debts. By filing under Subchapter V, you can resolve significant SBA obligations for a fraction of the cost of traditional Chapter 11 filings. With legal fees typically ranging from $15,000 to $25,000 plus filing fees, this approach can be a lifeline for struggling business owners.
SBA loan default attorneys are adept at negotiating with SBA representatives and loan servicers. They leverage their authorization under the Agency Practice Act to directly engage in negotiations, ensuring that your interests are robustly represented. This can be crucial in reducing the debt burden and protecting your assets.
If your SBA loan is transferred to the U.S. Department of Treasury for collection, the consequences can be severe. A skilled attorney can implement strategies to prevent or mitigate these actions, such as wage garnishments or asset seizures. This defense not only protects your financial stability but also provides peace of mind during a stressful period.
In some cases, disputes may arise that require formal hearings or appeals. SBA loan default lawyers are equipped to represent you in these proceedings, whether they occur before the SBA Office of Hearings and Appeals or other relevant bodies. Their expertise ensures that your case is presented effectively, increasing the likelihood of a favorable outcome.
Personal guarantees are common in SBA loans, and they pose a significant risk to your personal assets. An SBA loan default lawyer can help you understand the implications of these guarantees and explore ways to limit their impact. This might involve negotiating with lenders to release or restructure the guarantee terms.
Protecting personal assets requires a strategic approach. Attorneys can advise on asset protection strategies, such as leveraging exemptions under state and federal laws, to shield certain assets from creditors. This proactive defense is vital in preserving your financial future.

Our firm successfully resolved an SBA COVID-19 Economic Injury Disaster Loan (EIDL) in the original amount of $150,000 for a Florida-based borrower. The loan, issued on June 4, 2020, was secured by business assets and potential personal liability through the SBA's Security Agreement.
Following the permanent closure of the business, we guided the client through the SBA’s Business Closure Review process and prepared a comprehensive collateral analysis. We negotiated directly with the SBA, obtaining a full release of the business collateral for $2,910 — satisfying the borrower’s obligations under the Security Agreement and eliminating any further enforcement risk against the pledged assets.

Client’s small business obtained an SBA 7(a) loan for $150,000. He and his wife signed personal guarantees and pledged their home as collateral. The SBA loan went into default, the term or maturity date was accelerated and demand for payment of the entire amount claimed was made. The SBA lender’s note gave it the right to adjust the default interest rate from 7.25% to 18% per annum. The business filed for Chapter 11 bankruptcy but was dismissed after 3 years due to its inability to continue with payments under the plan. Clients wanted to file for Chapter 7 bankruptcy, which would have been a mistake as their home had significant equity to repay the SBA loan balance in full as the Trustee would likely seize and sell the home to repay the secured and unsecured creditors. However, the SBA lender opted to pursue the SBA 7(a) Guaranty and subsequently assigned the loan and the right to enforce collection to the SBA. Clients then received the SBA Official 60-Day Notice and hired the Firm to respond to it and negotiate on their behalf. Clients disputed the SBA’s alleged balance of $148,000, as several payments made to the SBA lender during the Chapter 11 reorganization were not accounted for. To challenge the SBA’s claimed debt balance, the Firm Attorneys initiated expedited discovery to obtain government records. SBA records disclosed the true amount owed was about $97,000. Moreover, because the Clients’ home had significant equity, they were not eligible for an Offer in Compromise or an immediate Release of Lien for Consideration, despite being incorrectly advised by non-attorney consulting companies that they were. Instead, our Firm Attorneys recommended a Workout of $97,000 spread over a lengthy term and a waiver of the applicable interest rate making the monthly payment affordable. After back and forth negotiations, SBA approved the Workout proposal, thereby saving the home from imminent foreclosure and reducing the Clients' liability by nearly $81,000 in incorrect principal balance, accrued interest, and statutory collection fees.

Small business sole proprietor obtained an SBA COVID-EIDL loan for $500,000. Client defaulted causing SBA to charge-off the loan, accelerate the balance and refer the debt to Treasury's Bureau of Fiscal Service for aggressive collection. Treasury added $180,000 in collection fees totaling $680,000+. Client tried to negotiate with Treasury but was only offered a 3-year or 10-year repayment plan. Client hired the Firm to represent before the SBA, Treasury and a Private Collection Agency. After securing government records through discovery and reviewing them, we filed an Appeals Petition with the SBA Office of Hearings & Appeals (OHA) court challenging the SBA's referral of the debt to Treasury citing a host of purported violations. The Firm was able to negotiate a reinstatement and recall of the loan back to the SBA, participation in the Hardship Accommodation Plan, termination of Treasury's enforced collection and removal of the statutory collection fees.
