Treasury Debt Defense: Your Rights Against Federal Collection Actions

Understanding Your Rights in Federal Debt Collection

Facing Treasury Department debt can be daunting, especially when federal agencies commence aggressive collection actions. However, understanding your rights and the strategies available for Treasury debt defense can empower you to navigate these challenges effectively. This guide provides insights into federal debt collection, explores your rights, and outlines actionable steps for Treasury offset prevention and successful debt resolution.

The Mechanics of Federal Debt Collection

Federal debt collection involves several mechanisms that the U.S. Department of Treasury can employ to recover outstanding debts. These debts may arise from delinquent taxes, defaulted student loans, or other federal obligations. Recognizing these collection tools is crucial in formulating an effective defense strategy.

Treasury Offset Program (TOP)

The Treasury Offset Program is a primary tool utilized by the Treasury Department to collect debts owed to federal agencies. Under TOP, the Treasury can intercept federal payments, such as tax refunds or Social Security benefits, to offset outstanding debts.

Administrative Wage Garnishment

The Treasury may also implement administrative wage garnishment, which allows it to directly withhold a portion of your wages to settle debts without requiring a court order. Understanding the limitations and conditions of this process is vital for debtors.

Federal Tax Liens

If your debt is tax-related, the IRS may file a federal tax lien, attaching your property to secure payment. This lien can affect your credit rating and complicate property sales, making timely resolution essential.

Asserting Your Rights: A Strategic Approach

When facing federal debt collection, it's important to remember that you have rights and options. Knowing these rights can significantly impact your Treasury debt defense strategy.

Right to Due Process

Due process is a fundamental right, ensuring that you receive fair treatment throughout the debt collection process. This includes the right to be notified of any collection actions and the opportunity to dispute inaccuracies or negotiate terms.

Right to Dispute Debts

You have the right to dispute federal debts if you believe they are incorrect. This involves requesting a debt validation and providing evidence that challenges the debt's legitimacy. Engaging with the Treasury Department promptly is essential to exercising this right effectively.

Right to Financial Hardship Considerations

Federal agencies may consider financial hardship situations when initiating collection actions. If you are experiencing significant financial distress, you can request a review or modification of your payment obligations.

Steps to Effective Treasury Debt Defense

Navigating federal debt collection demands a strategic approach. Here are key steps to consider in building a robust Treasury debt defense strategy:

Evaluating the Debt

Start by thoroughly evaluating the debt in question. Request a comprehensive debt validation from the Treasury Department, ensuring that all details, including the amount and origin, are accurate. Discrepancies can be leveraged in disputes or negotiations.

Engaging in Negotiations

Negotiating with federal agencies can result in favorable terms, such as reduced payments or extended timelines. Consider proposing an Offer in Compromise (OIC) if you cannot pay the full debt amount. This requires demonstrating financial inability and may involve asset liquidation.

Exploring Treasury Offset Prevention

Preventing offsets is a critical aspect of managing federal debts. To do this, communicate with the agency early, explain your situation, and explore potential payment arrangements. Being proactive can often prevent offsets before they occur.

Seeking Professional Assistance

Given the complexity of federal debt collection, seeking professional assistance is advisable. Attorneys authorized to practice before the Treasury Department can provide expert guidance, helping you understand your rights and develop a tailored defense strategy.

Treasury Offset Prevention Techniques

Preventing a Treasury offset can protect your financial resources and provide breathing room as you address your debt obligations. Here are some strategies to consider:

Requesting a Hardship Suspension

If you're unable to meet your financial obligations due to hardship, request a temporary suspension of collection activities. This request should be accompanied by documentation proving your financial situation, such as income statements or medical bills.

Setting Up a Payment Plan

Establishing a payment plan with the Treasury Department can prevent offsets by demonstrating your commitment to resolving the debt. Payment plans can be structured to fit your financial capacity, allowing you to manage your obligations without severe disruptions.

Contesting the Debt

If you believe the debt amount or validity is incorrect, contest it formally. Provide documentation and explanations supporting your claim, and ensure that all correspondences are well-documented for future reference.

Navigating Administrative Wage Garnishment

Administrative wage garnishment is a serious concern for many debtors. Understanding how it works and how to mitigate its impact is crucial for effective Treasury debt defense.

Understanding Garnishment Limits

Federal laws impose limits on wage garnishment amounts, typically capping it at a percentage of your disposable income. Familiarize yourself with these limits to ensure compliance with legal requirements.

Challenging the Garnishment

You can challenge a wage garnishment by requesting a hearing. During the hearing, present evidence of financial hardship or errors in the debt calculation. Successfully challenging a garnishment can lead to reduced amounts or complete cessation.

Negotiating Voluntary Payments

Proposing voluntary payments can sometimes prevent wage garnishments. By demonstrating willingness to cooperate and make payments, you may persuade the Treasury Department to forego garnishment actions.

Building a Comprehensive Defense Strategy

To effectively manage federal debt collection, a comprehensive defense strategy is essential. Here are key elements to include:

Documentation and Record Keeping

Maintain meticulous records of all communications with the Treasury Department. This includes correspondence, payment receipts, and notices. Proper documentation strengthens your position in disputes and negotiations.

Understanding Regulatory Frameworks

Familiarize yourself with the regulatory frameworks governing federal debt collection, such as the Debt Collection Improvement Act and the Federal Claims Collection Standards. Knowledge of these regulations can guide your defense strategy.

Leveraging Legal Expertise

Consider engaging legal professionals experienced in Treasury debt defense. Their expertise can provide insights into nuanced strategies, procedural requirements, and negotiation tactics.

Conclusion: Taking Control of Your Financial Future

Facing federal debt collection is undoubtedly challenging, but understanding your rights and options empowers you to take control of your financial future. $58,000 SBA 7A LOAN - AWG HEARING DEFENSE

$58,000 SBA 7A LOAN - AWG HEARING DEFENSE

Client personally guaranteed SBA 7(a) loan balance of $58,000.  The client received a notice of Intent to initiate Administrative Wage Garnishment (AWG) Proceedings.  We represented the client at the hearing and successfully defeated the AWG Order based on several legal and equitable grounds.

$50,000 SBA 7A LOAN - RESPONSE TO SBA OFFICIAL 60-DAY NOTICE

$50,000 SBA 7A LOAN - RESPONSE TO SBA OFFICIAL 60-DAY NOTICE

Client received the SBA's Official 60-Day Notice for a loan that was obtained by her small business in 2001.  The SBA loan went into default in 2004 but after hearing nothing from the SBA lender or the SBA for 20 years, out of the blue, she received the SBA's collection due process notice which provided her with only one of four options: (1) repay the entire accelerated balance immediately; (2) negotiate a repayment arrangement; (3) challenge the legal enforceability of the debt with evidence; or (4) request an OHA hearing before a U.S. Administrative Law Judge.

Client hired the Firm to represent her with only 13 days left before the expiration deadline to respond to the SBA's Official 60-Day Notice.  The Firm attorneys immediately researched the SBA's Official loan database to obtain information regarding the 7(a) loan.  Thereafter, the Firm attorneys conducted legal research and asserted certain affirmative defenses challenging the legal enforceability of the debt.  A written response was timely filed to the 60-Day Notice with the SBA subsequently agreeing with the client's affirmative defenses and legal arguments.  As a result, the SBA rendered a decision immediately terminating collection of the debt against the client's alleged personal guarantee liability saving her $50,000.

$391,000 SBA COVID EIDL - CROSS-SERVICING DISPUTE | NEGOTIATED REINSTATEMENT & WORKOUT

$391,000 SBA COVID EIDL - CROSS-SERVICING DISPUTE | NEGOTIATED REINSTATEMENT & WORKOUT

Client's small business obtained an SBA COVID EIDL for $301,000 pledging collateral by executing the Note, Unconditional Guarantee and Security Agreement.  The business defaulted on the loan and the SBA CESC called the Note and Guarantee, accelerated the principal balance due, accrued interest and retracted the 30-year term schedule.

The loan was transferred to the Treasury's Bureau of Fiscal Service which resulted in the statutory addition of $90,000+ in administrative fees, costs, penalties and interest with the total debt now at $391.000+. Treasury also initiated a Treasury Offset Program (TOP) levy against the client's federal contractor payments for the full amount each month - intercepting all of its revenue and pushing the business to the brink of bankruptcy.

The Firm was hired to investigate and find an alternate solution to the bankruptcy option.  After submitting formal production requests for all government records, it was discovered that the SBA failed to send the required Official 60-Day Pre-Referral Notice to the borrower and guarantor prior to referring the debt to Treasury. This procedural due process violation served as the basis to submit a Cross-Servicing Dispute to recall the debt from Treasury back to the SBA and to negotiate a reinstatement of the original 30-year maturity date, a modified workout, cessation of the TOP levy against the federal contractor payments and removal of the $90,000+ Treasury-based collection fees, interest and penalties.
